Nairobi - The Kenya Magistrate's and Judges Association (KMJA) has called out the Inspector General of Police for failing to arrest Mumias East MP Peter Salasya.
Through the law firm of Danstan Omari and Associates Advocates, the association has written to the Director of Public Prosecution demanding that he direct IG Japheth Koome to arrest Salasya.
Why KMJA want Salasya arrested
KMJA accused the police and the DCI of inaction, wondering whether the youthful MP was above the law even after he was allegedly seen daring the police to arrest him while flashing KSh 500,000.

"Hon. Peter Salasya has gone ahead to boast publicly that no one can arrest him and that nothing can be done to him.
The same is interpreted by our client to be a mockery of our security and justice organs in the country and portrays the said national institutions as weak and incapable of enforcing the law," the letter to the DPP reads.
KMJA says Salasya is not above the law
KMJA called out Koome and DCI boss Mohammed Amin for their inaction after they claimed they could not locate him.
"The MP whom the DCI is claiming is not available to be arrested has been seen on social media with the KSh 500,000 daring the police to come and arrest him. Such an impunity has never been witnessed in this country. We know numerous CS's and politicians who have been arrested.
Honourable Salasya is not above the law, we have had judicial officers die under mysterious circumstances, the police should do their job," they stated.
Omari, acting on behalf of judges and magistrates, asked the DPP to invoke Article 157 of the Constitution, which gives him the power to direct the IG to arrest and forward Salasya's file for arraignment.
"Our client hereby calls upon your office to enforce Article 157 (4) of the Constitution of Kenya, 2010 by directing the Inspector General of Police to arrest the said hon. Member of Parliament under the IG's mandate stated at Article 245(4) (a) and (b) of the Constitution," read the letter in part.
Salasya allegedly threatens magistrate
Magistrate Gladys Kiama of the Kakamega Small Claims Court directed Salasya to pay Robert Lutta a KSh.500,000 debt with interest and cost of the case after the businessman filed a lawsuit challenging the legislator to pay the money he lent him on December 13, 2022, with the agreement that he would repay after two months.
She said minutes after she delivered her judgement, the MP followed her outside the courtroom and threatened to kill her.
Both the Chief Justice and KMJA have condemned the youthful MP in separate statements.
The Law Society of Kenya and the Judicial Service Commission have called for his arrest to no avail.
